Terms of Service

Agreement

These terms govern your use of Kibet Brian at https://kibetbrian.codes and any project work or paid offering you buy from me. The site is operated by Kibet Brian, an independent developer based in Kenya. By using the site, requesting a quote, or making a payment, you accept these terms.

Services

I design and build web applications, mobile applications, APIs and backend systems, system architecture, and performance optimization, as listed on the contact page. Each engagement is scoped in a written quote describing what will be delivered, the timeline, and the price.

Work begins once you approve the quote and pay any deposit stated in it. Timelines are good-faith estimates and move with the complexity of the work and the speed of your feedback.

Pricing, taxes, and payment

Project prices are quoted per engagement, and fixed plans are Website / Web App, Mobile Dev, AI Integration. Every plan and what it includes is listed on the contact page. All prices are in US dollars unless your quote says otherwise.

Prices do not include taxes, duties, or provider fees. Any applicable VAT, sales tax, withholding tax, bank charges, network or gas fees, and mobile money transaction charges sit with you on top of the quoted price.

I accept bank wire transfer, cryptocurrency, and mobile money. You pay through the provider directly. Work starts once your 50% deposit clears, and cryptocurrency payments need on-chain confirmation first.

I may change pricing at any time, and the price on your approved quote is locked in for that engagement. Late payments pause the work until the account is current.

Delivery and revisions

I deliver what the quote describes, in the milestones it sets. Each milestone includes the review window stated in your quote, or 7 days where none is stated. Tell me what needs changing inside that window and I will revise it.

Each engagement includes the revision rounds stated in your quote, or one round where none is stated. New scope requested mid-project is quoted separately and scheduled after the agreed work.

Ownership

You own the finished work in full once final payment clears, including the code, designs, and content built for you. Until then, the work remains mine.

I may show finished non-confidential work in this portfolio and mention the engagement, unless I agree in writing, such as under an NDA, that the work stays private.

Confidentiality

I treat your business information, credentials, user data, and anything marked confidential as exactly that, and use it only to deliver your project. Where you need stronger protection, I will sign your NDA before work begins, and NDA projects are never shown or named.

Cancellation and refunds

You can cancel project work at any time by emailing its.kibetbrian@gmail.com. A deposit is refunded in full if no work has started. Once work has started, the deposit covers reserved time and is not refundable, and you pay for milestones already delivered.

Fixed plans follow the same rule: a full refund within 14 days of payment where work has not started yet, and payment for milestones already delivered after that.

If I cannot deliver through my own fault, I refund the affected amount to the original payment method. Crypto refunds go to a wallet address you provide, net of network fees.

What I need from you

Timely content, decisions, credentials, and access for anything only you can provide. Delays on your side move delivery dates by at least as much. You confirm you own or hold the rights to every text, image, logo, and dataset you hand over.

Acceptable use

Do not ask me to build anything illegal, anything that harms others such as malware or hate content, or anything that infringes someone else's rights. Do not attempt to disrupt the site or scrape it in a way that degrades service for others. I may decline or stop work that crosses these lines, and refund any unearned amount.

No warranty

Project work is delivered with professional care and includes fixes for defects found inside your review window. Beyond that, the site and all deliverables are provided "as is", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Third-party services your project depends on, such as hosting, app stores, and payment providers, sit outside my control.

Limitation of liability

To the extent permitted by law, my total liability for any claim relating to the site, the services, or a purchase is limited to the amount you paid me in the 12 months before the claim, and is zero where you paid me nothing. I am not liable for indirect or consequential loss, including lost profits or lost data.

Changes to these terms

I may update these terms as the services change. The date at the top reflects the current version. If a change materially affects an active engagement, I email you before it applies. Continuing to use the site after an update means you accept it.

Resolving a problem

Almost everything is fixable by email. If you are unhappy with the work, a charge or anything else, write to its.kibetbrian@gmail.com with the details before taking any other step. I will work with you in good faith to sort it out, and in most cases the answer is simply a fix or a refund.

Both sides agree to try to resolve a dispute this way for at least 30 days from the day it is raised in writing, before starting any formal proceedings. Nothing here stops either side from going to court sooner where the law gives you that right.

Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction over any dispute. If you are a consumer, this does not remove protections you have under the law of your own country.
